Hotel Hübner provides its guests with internet access via a Wi-Fi network. The following agreements regulate its use for the benefit of all parties involved.

1. Authorisation for the shared use of Wi-Fi internet access

The proprietor operates access to the internet via Wi-Fi hotspots in its tourist accommodation business (“Beherbergungsbetrieb”, BHB) named Hotel Hübner. Guests are authorised to use the Wi-Fi internet access for the duration of their stay at Hotel Hübner. Shared use is a free service provided by Hotel Hübner and may be withdrawn at any time. Guests are not entitled to authorise third parties to use the Wi-Fi access.

The proprietor assumes no liability for the actual availability, suitability or reliability of access to the internet for a specific purpose. The proprietor is authorised to discontinue the operation of the Wi-Fi in whole, in part or temporarily at any time, to admit further co-users and to restrict or exclude guest access in whole, in part or temporarily. In particular, the proprietor reserves the right to block access to certain pages or services via Wi-Fi at its own discretion and at any time (e.g. pages containing violent, pornographic or paid content).


2. Access data

To access the internet, users enter a user name and password. The access data (user name and password) are for the guest's personal use only and may not be disclosed to third parties under any circumstances. The guest agrees not to disclose his/her access data. The proprietor is entitled to change access codes at any time.


3. Risks of using Wi-Fi, limitation of liability

The guest is advised that Wi-Fi only facilitates access to the internet; a firewall and virus protection are not included. The data traffic generated using Wi-Fi is not encrypted. This means that the data may be viewed by third parties. The proprietor expressly advises that there is a risk that malware (e.g. viruses, Trojans, worms, etc.) may infect the end device when Wi-Fi is used.

Use of Wi-Fi is at the guest's own risk and responsibility. The BHB assumes no liability for damage to the guest's PC resulting from the use of internet access, unless the damage was caused intentionally or as a result of gross negligence on the part of the BHB.


4. Responsibility and exemption from claims

The guest is responsible for the data transmitted via Wi-Fi, the fee-based services used and the legal transactions concluded. If the guest visits fee-based websites or incurs liabilities, the costs resulting therefrom shall be borne by the guest.

The guest is obliged to comply with applicable laws when using Wi-Fi. In particular, the guest shall:

  • not use Wi-Fi to access or disseminate content that contravenes public decency or the law;
  • not illegally reproduce, distribute or make available any material protected by copyright;
  • comply with the applicable regulations for the protection of minors;
  • not send or disseminate any content that is abusive, defamatory or threatening;
  • not use Wi-Fi to distribute mass mailings (spam) and/or other prohibited forms of advertising.

The guest releases the proprietor of Hotel Hübner from all damages and claims asserted by third parties that are based on the guest's unlawful use of Wi-Fi and/or a breach of this agreement; this also extends to costs and expenses associated with the claim or defending it. Should the guest become aware or if he/she should be aware that such an infringement and/or such an offence has occurred or is imminent, the guest is obliged to inform the proprietor of the Hotel Hübner of this fact.
